Agreement to Terms
By downloading, accessing, or using the Trail Soda website or services (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
ALWAYS OBEY ALL LOCAL, STATE AND FEDERAL LAWS WHEN TRAVERSING ON OR OFF-ROAD. Use our mapping at your own risk. The information on our maps was compiled from crowd sourcing as well as other riders who share data. Special care was taken in the final result of our maps. We do not accept any responsibility for errors, omissions, or positional accuracy. We do not accept liability for any loss, damage, death or other negative occurrence as a result of using our mapping maps including trespassing on private property. Trails and /or routes may be removed or reworked at any time without notification. There are no warranties, expressed or implied, including the warranty of merchant-ability or fitness for a particular purpose, accompanying this product. Our trail and track data is not permitted to be removed from the device, distributed or copied to another device at any time. By accepting, and using our product you agree to the terms set forth in this disclaimer.

We provide offline base maps and tools to plan routes, record tracks, create custom waypoints, and share track packs.

We do not provide tracks. Tracks and POIs are created and shared by riders. Availability, legality, and accuracy can vary and change.
Always verify conditions and access locally and follow applicable laws and land rules.
Safety and Disclaimer
Mapping is a navigational aid for reference only. It does not direct your conduct, grant access rights, or replace your judgment.

Off‑road travel involves hazards (terrain, weather, wildlife, mechanical issues, limited connectivity). You assume all risks.

Obey closures, signs, land use rules, and private property. If access is unclear or restricted, turn back.

Do not interact with the device while moving. Stop first, or have a passenger operate the app.

Maps, tracks, and waypoints may be incomplete, inaccurate, or unavailable. Verify conditions with official sources.
No Warranties. The Service is provided “as is” and “as available,” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non‑infringement.
Limitation of Liability; Indemnification
To the fullest extent permitted by law, Trail Soda and its owners, contributors, and partners are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; or for lost profits, data, goodwill, or equipment, arising from or related to use of the Service. Our total aggregate liability for all claims will not exceed the greater of US $100 or the amounts you paid to Trail Soda in the 12 months before the claim.
You agree to defend, indemnify, and hold Trail Soda harmless from claims, damages, costs, and fees (including reasonable attorneys’ fees) arising from your use of the Service, your riding activities, your content, or your breach of these Terms or law.
Suspension and Termination
We may suspend or terminate access for violations, suspected abuse, fraud, piracy, or legal reasons. You may stop using the Service at any time by deleting the app and canceling your subscription.
Force Majeure
We are not responsible for failures or delays caused by events beyond our control, including natural disasters, government actions, connectivity issues, cyberattacks, or third‑party outages.
Governing Law and Disputes
These Terms are governed by the laws of West Virginia, USA, without regard to conflict‑of‑law rules. Venue and exclusive jurisdiction lie in the state and federal courts located in West Virginia, USA.
No Class Actions. You and Trail Soda waive any right to participate in class, consolidated, or representative actions. Claims must be brought in an individual capacity. If a term is found unenforceable, the remaining terms remain in effect.
Changes to These Terms
We may update these Terms as our products or laws change. We will post updates here and update the effective date. Continued use of the Service after changes means you accept the updated Terms.
